La Comisi\u00f3n de Protecci\u00f3n Civil, Seguridad P\u00fablica, Prevenci\u00f3n y Reinserci\u00f3n Social, que preside el legislador, Miguel \u00c1ngel Covarrubias Cervantes, present\u00f3 la iniciativa con proyecto de decreto, por el que se deroga el art\u00edculo 183 del C\u00f3digo Penal para el Estado Libre y Soberano de Tlaxcala. <\/p>\n\n\n\n
El congresista explic\u00f3 que la iniciativa busca derogar el delito de ultrajes a la autoridad, porque su apreciaci\u00f3n conlleva a una descripci\u00f3n imprecisa, constituyendo un tipo penal abierto a interpretaciones arbitrarias, muchas veces a consideraci\u00f3n de las autoridades encargadas de la procuraci\u00f3n de justicia, lo que puede derivar en detenciones injustificadas o incluso arbitrarias. <\/p>\n\n\n\n
En la vig\u00e9sima octava sesi\u00f3n ordinaria, el diputado se\u00f1al\u00f3 que la Suprema Corte de Justicia de la Naci\u00f3n (SCJN), ha se\u00f1alado que el vocablo \u00abultraje\u00bb es un t\u00e9rmino con una referencia indeterminada a un amplio espectro de conductas, por lo que resulta complejo el grado de afectaci\u00f3n que debe producir determinada acci\u00f3n para actualizar el delito.<\/p>\n\n\n\n
En este sentido, consider\u00f3 necesario derogar el art\u00edculo 183 del C\u00f3digo Penal, en tenor de que resulta primordial atender los precedentes judiciales locales y de car\u00e1cter internacional, as\u00ed como las recomendaciones emitidas en materia de protecci\u00f3n a los derechos humanos, a fin de no criminalizar a las personas por ejecutar su derecho a libre expresi\u00f3n de ideas. <\/p>\n\n\n\n
De esta manera, la presente iniciativa, fue turnada a comisiones unidas de Protecci\u00f3n Civil, Seguridad P\u00fablica, Prevenci\u00f3n y Reinserci\u00f3n Social y a la de Puntos Constitucionales, Gobernaci\u00f3n y Justicia y Asuntos Pol\u00edticos para su an\u00e1lisis, discusi\u00f3n y dictamen correspondiente.<\/p>\n","protected":false},"excerpt":{"rendered":"
