{"id":117689,"date":"2023-12-01T17:19:36","date_gmt":"2023-12-01T23:19:36","guid":{"rendered":"https:\/\/diariolanoticia.com.mx\/?p=117689"},"modified":"2023-12-01T17:19:37","modified_gmt":"2023-12-01T23:19:37","slug":"niegan-suspension-definitiva-contra-designacion-del-titular-del-ofs","status":"publish","type":"post","link":"https:\/\/diariolanoticia.com.mx\/?p=117689","title":{"rendered":"Niegan suspensi\u00f3n definitiva contra designaci\u00f3n del titular del OFS"},"content":{"rendered":"\n<p>\u00b7&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<em>El Juez determin\u00f3 que la suspensi\u00f3n es improcedente, toda vez que la designaci\u00f3n del Auditor Superior, ya ocurri\u00f3.<\/em><\/p>\n\n\n\n<p>El pasado 29 de noviembre del presente a\u00f1o, fue notificada al Congreso del Estado de Tlaxcala, la resoluci\u00f3n de fecha 27 de noviembre, realizada por el Juez del Distrito Tercero del Estado de Tlaxcala, Carlos Alberto \u00c1vila Mu\u00f1oz, misma en la que neg\u00f3 la suspensi\u00f3n definitiva que buscaba dejar sin efectos el proceso de selecci\u00f3n del Auditor de Fiscalizaci\u00f3n Superior. Lo anterior, respecto al juicio de amparo 1551\/2023<\/p>\n\n\n\n<p>Entre los argumentos que el Juez de Distrito esgrimi\u00f3, fue que la suspensi\u00f3n no puede tener&nbsp;<em>efectos retroactivos<\/em>, sobre un acto jur\u00eddicamente&nbsp;<em>consumado<\/em>, por lo tanto, no es procedente, debido a que los efectos de la suspensi\u00f3n no pueden ser restitutivos,&nbsp;<em>\u00fanicamente suspensivos<\/em>.<\/p>\n\n\n\n<p>Ante la determinaci\u00f3n por la que \u00abse niega la suspensi\u00f3n definitiva\u00bb, el Congreso del Estado de Tlaxcala, reafirma no s\u00f3lo la legalidad del nombramiento del titular del \u00d3rgano de Fiscalizaci\u00f3n Superior, Arturo Lucio Salas Miguela; sino el inter\u00e9s de las y los diputados para realizar procesos transparentes, abiertos e incluyentes y por consenso de todas las fuerzas pol\u00edticas representadas en la LXIV Legislatura.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>\u00b7&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;El Juez determin\u00f3 que la suspensi\u00f3n es improcedente, toda vez que la designaci\u00f3n del Auditor Superior, ya ocurri\u00f3.
