Durante la vig\u00e9sima cuarta sesi\u00f3n ordinaria, las y los integrantes de la LXIV Legislatura del Congreso del Estado, aprobaron por mayor\u00eda de votos el dictamen emitido por la Comisi\u00f3n de Puntos Constitucionales, Gobernaci\u00f3n y Justicia y Asuntos Pol\u00edticos, en el que se da el correspondiente desahogo al expediente parlamentario, por el cual, Marisol Barba P\u00e9rez presenta ante esta soberan\u00eda su renuncia voluntaria y con car\u00e1cter de irrevocable al cargo de Magistrada Interina del Tribunal Superior de Justicia del Estado de Tlaxcala.<\/p>\n\n\n\n
En la m\u00e1xima tribuna del Estado, el legislador Jorge Caballero Rom\u00e1n en calidad de vocal de la Comisi\u00f3n de Puntos Constitucionales, dio lectura al dictamen, del cual se analiz\u00f3 el escrito por el cual se expresa la voluntad definitiva de Marisol Barba P\u00e9rez, de renunciar de manera irrevocable al cargo actualmente desempe\u00f1ado, en cumplimento a la facultad legal establecida el art\u00edculo 54 fracciones XXVII y XXXIII de la Constituci\u00f3n Pol\u00edtica del Estado Libre y Soberano de Tlaxcala.<\/p>\n\n\n\n
La comisi\u00f3n dictaminadora se\u00f1al\u00f3 que el cargo que desempe\u00f1aba la Magistrada no era de elecci\u00f3n popular, no le son aplicables los supuestos de art\u00edculo 118 de la Constituci\u00f3n local, y se determin\u00f3 que dicha renuncia es de manera voluntaria y en total goce de sus derechos; adem\u00e1s, esta Soberan\u00eda no tiene conocimiento sobre ning\u00fan procedimiento por responsabilidad y\/u omisi\u00f3n que impidan su renuncia, as\u00ed que las y los legisladores declararon procedente la renuncia legal.<\/p>\n\n\n\n
De esta manera con 21 votos a favor, las y los congresistas aprobaron este decreto y se instruy\u00f3 para que la Secretar\u00eda Parlamentaria, a trav\u00e9s del Actuario parlamentario, notifique a la Gobernadora del Estado y al Tribunal Superior de Justicia, para que conforme a lo establecido en el art\u00edculo 28 p\u00e1rrafo primero de la Ley Org\u00e1nica del Poder Judicial del Estado de Tlaxcala, se realicen los efectos legales correspondientes. <\/p>\n","protected":false},"excerpt":{"rendered":"
